1. Who processes customer data?
According to the General Data Protection Regulation (EU) 2016/679 ("GDPR") of the European Parliament and of the Council, the processing of personal data means any systematic operation with personal data, such as collection, recording, structuring, organisation, use, storage, alteration, retrieval, consultation, dissemination, erasure or destruction. Either the controller or the processor may process personal data. The controller of personal data is the one who determines the purpose of the processing of personal data, carries out its processing and is responsible for it. The processor is then the one who processes personal data on the basis of a contractual relationship with the controller.
The data controller of the personal data of existing or future Sportisimo customers and visitors to the Sportisimo website (collectively "customer" or "customers") is Sportisimo s. r. o., with registered office at Řevnická 170/4, 155 21 Prague 5 - Třebonice, Czech Republic, Business ID: 26194627, Registered with the Municipal Court in Prague, under File No. C 78675 ("Sportisimo").
2. What personal data does Sportisimo process?
Sportisimo processes only personal data that the customer provides to Sportisimo in connection with the use of Sportisimo services (e.g. in the context of a contractual relationship, handling of claims, legitimate interest of the controller, legal reasons, etc.), or the conclusion of a contract for the use of this service.
- Identification and contact data - this includes name, surname, date and place of birth, permanent address or other residence, type, telephone number, e-mail address or other similar contact data, in the case of a customer who is a natural person, also a Business ID number and Tax ID number. Other possible identification data are the IP address of the device used by the customer, the signature specimen, the account number that Sportisimo maintains for the customer and other specific authentication data agreed between the customer and Sportisimo.
- The data necessary to decide whether to enter into a contract with a customer - this includes the data necessary to assess the financial risk of the transaction.
- Data arising from the fulfilment of obligations under contracts and arising from Sportisimo's activities - these arise after the provision of the product or service to the customer, and are, for example, the duration of the contract, the status of Sportisimo's receivables from the customer, the status of the customer's receivables from Sportisimo, the history of the goods ordered, etc.
- Recording of customer communication - Sportisimo monitors and records selected customer communication, in particular telephone calls and e-mail In the case of recording telephone calls, the customer is informed of this. The content of these communications is confidential and is used solely for the purpose of complying with legal and contractual obligations, protecting rights and legally protected interests and for customer care purposes.
In summary, this is most often the information that a customer may provide to Sportisimo when registering or using certain Sportisimo services:
- Title

- Last name:
- Gender
- Business ID, or Tax ID
- Date of birth
- Residence / contact address
- Mobile phone or other phone number
- E-mail address
- An audio or written record of the communication
- Video footage when visiting a Sportisimo store or premises

and may also obtain, under the conditions defined below, the data that Sportisimo obtains from the customer by the customer's use of Sportisimo's online services:
- IP address
- Cookies
- Alternatively, another online identifier
- Sportisimo does not process personal data falling under special categories of personal data, so-called sensitive data (such as data revealing racial or ethnic origin, data concerning religious or philosophical beliefs, or data concerning the sex life or orientation of an individual).
3. Why does Sportisimo process the personal data of customers?
- Sportisimo adheres to the following basic principles when processing the personal data of customers:
- Personal data of customers are always processed by Sportisimo only for a clearly and comprehensibly defined purpose, by lawful means and only for the time necessary for the purpose of processing. Sportisimo processes accurate personal data and only to the extent necessary for the performance of contractual obligations or for the fulfilment of the purpose for which the personal data is processed.
- The personal data of customers is protected and processed in a manner that prevents any unauthorized or accidental access to, alteration, destruction, loss or other unauthorized processing of such personal data. For these purposes, Sportisimo maintains appropriate technical and organizational measures and all persons who come into contact with the personal data of customers are obliged to maintain the confidentiality of information obtained in connection with the processing of personal data.
- Sportisimo informs its customers about the processing of their personal data and their rights related to this processing.
- In order to deliver goods and services to customers, Sportisimo needs to know and process customers' personal data. Sportisimo processes personal data in particular for the purpose of concluding a contract, including negotiations prior to the conclusion of such contract, and the performance of the contractual relationship, and the legal basis for such processing is therefore the performance of the contract (or the legitimate interest of Sportisimo, especially in cases where the customer is a legal entity and Sportisimo processes the personal data of its contact persons).
- Sportisimo processes the personal data of customers primarily for the purpose of delivering goods and managing the customer relationship with customers. Sportisimo continues to process some of the data it holds about customers after the end of the contract. Specifically, Sportisimo processes personal data for the following purposes:
a. Sale of goods and related services
Sportisimo processes personal data when selling goods (i.e. sports equipment, clothing, spare parts, sports supplements and nutrition for athletes) to customers and providing related services (repair, maintenance, service and printing of goods).
- For these purposes, the personal data of the customer is processed by Sportisimo on the basis of the legal basis of the performance of the contract and/or the legitimate interest of the Controller. For this purpose, Sportisimo stores the personal data of customers for the duration of the contractual relationship, or for the duration of the warranty periods for the goods and during the limitation periods.
b. Registration and login to Sportisimo Club
Sportisimo offers the possibility to register for the Sportisimo Membership Club, including the creation of a customer account. Customers can become a member of the loyalty program by registering on the website or by registering at any Sportisimo store. The detailed terms and conditions of the loyalty program are set out in the Sportisimo Loyalty Program Terms and Conditions on the Sportisimo website. If the customer uses the Facebook or Google account login, the customer's user account will be linked to Sportisimo's customer interface and through this link Sportisimo will obtain the following personal data necessary solely for the purposes of creating and maintaining the customer account and authentication:
- From Google LLC: first and last name,e-mail address, language preference;
- From Facebook Ireland Ltd.: first and last name, e-mail address (as chosen by the customer on Facebook, information shared with Facebook Ireland Ltd.
For the purposes of inclusion in the loyalty program database and participation in the program, Sportisimo processes the following personal data of customers.
- identification data (name, surname);
- contact details (e-mail address, telephone number);
- details of goods and services supplied;
The purpose of processing personal data within the loyalty club is to improve marketing communication with customers and to obtain more accurate data on customer preferences and customer behaviour. Personal data will be processed through the use of automated profiling and the sending of relevant offers of promotional or discounted goods. For the purposes of the loyalty program, Sportisimo will process
customer data for the duration of the membership in the club, unless the customer withdraws his/her consent earlier.
c. Payments
Payments on the Sportisimo website are made via an external payment gateway. Sportisimo has access to customer payment data only to the extent of the first and last 4 numbers of the customer's payment card, the issuer of the payment card and the expiry date of the payment card used to pay for the purchase. Sportisimo does not process any other data about the customer's means of payment. The purpose of the processing is to make a purchase of goods or services on the Sportisimo website by means of payment by payment card.
d. Complaints
If the customer believes that the performance by Sportisimo is defective, they are entitled to claim the goods or services in accordance with the relevant civil law regulations and in accordance with the Complaints Procedure and Sportisimo's Terms and Conditions. The handling of complaints is part of the contractual performance within the relationship between the customer and Sportisimo and the obligation to handle complaints to Sportisimo also arises from legal regulations.
e. Customer support
If the customer contacts Sportisimo via the contact form, by telephone or otherwise, Sportisimo will process the data provided for the purpose of processing the response and handling the communication and will keep it until the customer's request is handled and, where applicable, for the time necessary to defend or assert Sportisimo's legal claims. Telephone calls with customers may be recorded with prior notice for the purpose of defending or pursuing legal claims against Sportisimo and to ensure the quality of Sportisimo's services.
f. Sending reminders
If an invoice due by the customer for the selected goods is not paid on time, Sportisimo may process the personal data of this customer for the purpose of sending a reminder until the invoice is paid or the payment is verified.
g. Determination, enforcement and defence of legal claims
After the termination of the contractual relationship, Sportisimo may also, on the basis of legitimate interest, retain some of the customer's personal data for the duration of the limitation periods, the processing of which is necessary for the protection of Sportisimo's rights and the possible defence of legal claims, including the recovery of outstanding payments or invoices.
h. Accounting and tax documents
Some personal data may be included on accounting documents (in particular invoices). According to applicable legislation (e.g. the Accounting Act or the Value Added Tax Act), Sportisimo is obliged to keep these documents for the purposes of accounting and tax records for up to 10 years. If Sportisimo is legally obliged to archive these documents, Sportisimo stores the personal data on the relevant tax document together with them.
i. Marketing communication
Sportisimo may also use customers' personal data for the purpose of sending newsletters of Sportisimo goods and services and other commercial communications related to Sportisimo goods and services. This includes news and offers that might be relevant to customers based on previous purchases and sporting preferences. Sportisimo may also send communications that are otherwise related to a purchase made by customers (e.g. installation instructions) or reminders regarding an unfinished purchase. Sportisimo will send news and similar commercial communications to customers via their contact details.
The legal basis for marketing communication in relation to customer status may be
- Consent to the sending of newsletters, which the customer can give to Sportisimo via the website
- Consent to membership in the Sportisimo Club, which the customer gives when registering for the club.
This processing will take place for the duration of the relevant consent. If the customer withdraws their consent to this processing, Sportisimo will cease to process the personal data of this customer for the purpose of sending marketing communications without further delay.
- Sportisimo's legitimate interest in direct marketing communication with its customers who have already purchased the goods.
This processing will take place for 3 years from the date of the last purchase. The customer may also object to this processing at any time, both via the unsubscribe link in each newsletter sent and at dpo@sportisimo.cz
In order for Sportisimo to send relevant marketing messages to customers, Sportisimo uses in particular the following personal data:
- identification data (name, surname);
- contact details (mailing address, e-mail address);
- information about the goods and services supplied by Sportisimo to the customer;
- customer preference data (data on the sports the customer participates in);
- information about the usual Sportisimo customer shop;
- customer activity data on the Sportisimo
j. Consumer competitions
In the event that the customer enters Sportisimo competitions, the customer acknowledges that Sportisimo will process the customer's data for the purpose of enabling the customer's participation in these competitions and their evaluation. The processing of customer data in the context of competitions is based on the customer's consent. The customer can withdraw their consent to participate in competitions organised by Sportisimo at any time and Sportisimo will stop processing the customer's data. Withdrawal of consent only has an effect in the future and therefore does not affect the lawfulness of previous processing based on this consent (before its withdrawal). Scope of processed data.
In order for the customer to participate in competitions, Sportisimo needs to process the following personal data to the extent that it is defined in the entry form when entering the competition, as well as personal data whose processing is necessary for the specific competition:
- identification data (name, surname);
- contact details (mailing address, e-mail address);
- the data on which the specific competition is based (e.g. data about your purchases, answers to knowledge questions, etc.).
The purpose of processing the customer's personal data is to enable participation in user competitions organised by Sportisimo in accordance with the terms and conditions of these competitions, including contacting the winner and delivering the prize, if applicable. For this purpose, Sportisimo processes the data until the end of the relevant competition and for a reasonable period of time, usually not exceeding 1 year after the end of the competition, in order to deliver any prizes or to resolve complaints or submissions from participants or other persons, or for control by the relevant public authorities.
k. User reviews
If a customer purchases from Sportisimo, Sportisimo may ask the customer to rate the product purchased. Sportisimo subsequently publishes these reviews on the page with the goods that the customer has rated, either anonymously or by providing the first name and country. Such processing of personal data takes place on the basis of the customer's consent, which the customer grants to Sportisimo by entering a rating for the relevant product. If the customer provides their e-mail address as part of the review, Sportisimo may process it so that Sportisimo can respond to the review provided. The customer may withdraw consent to the publication of the rating at any time and Sportisimo will delete the rating without undue delay or convert it into a pseudonymised or anonymous form. Withdrawal of consent only has an effect in the future and therefore does not affect the lawfulness of previous processing based on this consent (before its withdrawal).
Scope of processed data. Along with the customer's rating, Sportisimo may publish the following information on the product's website:
- identification data (first name, age group);
- an indication of how long the customer has used the goods;
- the date the evaluation was Purpose and duration of processing.
The purpose of the processing of the personal data of customers is to publish user reviews that can help other customers to choose a product and to send a response to the review provided. The user rating is processed for the duration of the offer of the goods on the website www.sportisimo.cz, or until the withdrawal of consent to processing.
l. Customer enquiries about the service/product offered
If the customer has a question about the product, they can write it on the website www.sportisimo.cz. Sportisimo then publishes customer questions and expert answers on the product page for which the customer has made a query. Such processing takes place on the basis of the customer's consent, which the customer grants to Sportisimo by entering a query for the relevant product. The customer may withdraw their consent to the publication of the enquiry at any time and Sportisimo will delete the enquiry without undue delay. Withdrawal of consent only has an effect in the future and therefore does not affect the lawfulness of previous processing based on this consent (before its withdrawal).
Along with the customer's enquiry, Sportisimo will publish the following information on the product's website:
- identification data (first name);
- a customer's question and an expert's Purpose and duration of processing.
The purpose of the processing of the personal data of customers is to publish user queries and expert answers that can help other customers in their product selection. User enquiries are processed for as long as the goods are offered on the website www.sportisimo.cz, or until the consent to processing is withdrawn.
m. Verified by Customers
If the customer is a customer of Sportisimo's e-shop, Sportisimo may also process the customer's personal data, unless otherwise specified below, in the scope of identification and contact data, information about the purchased goods, purchase rating and e-mail address, within the framework of the "Verified by Customers" program at Heureka Group a.s., for the purposes of Sportisimo's legitimate interest in determining Sportisimo's satisfaction with the purchase, evaluating feedback and analysing Sportisimo's market position. As part of the "Verified by Customers" program, Sportisimo determines the satisfaction of its customers with their purchases through e-mail questionnaires that Sportisimo sends to customers after each purchase, unless the customer refuses. The customer can object to the above processing of personal data and the sending of e- mail questionnaires within the "Verified by Customers" program at any time, both during each purchase at the Sportisimo e-shop and later by rejecting further questionnaires using the link in the e-mail with the questionnaire. The objection will always result in the cessation of the processing of the customer's personal data for these purposes, or no further questionnaire will be sent to the customer. The e-mail is encrypted immediately after the satisfaction survey is sent. The customer's personal data is processed in pseudonymised form for four years after the questionnaire has been filled in. The evaluations and the pseudonymised e-mail are kept for a period of 4 years from the date of the evaluation in order to detect fake evaluations and to verify the authenticity and credibility of these evaluations. On the other hand, identification, contact and order data are stored for 6 months after the evaluation has been provided in order to verify the authenticity and credibility of the evaluation. This is without prejudice to the relationship between the customer as a user of the www.heureka.cz portal and the operator of the Heureka.cz portal, Heureka Group a.s., as described in more detail in the Terms and Conditions of the "Verified by Customers” program, available here: https://www.heurekashopping.cz/pro-obchodni- partnery/podminky-pouzivani/podminky-pouzivani-programu-overeno-zakazniky.
4. COOKIES
When you visit our website, Sportisimo processes personal data via cookies. The purpose of this processing is to create traffic analyses and obtain other information about the use of our website by customers. More detailed information is provided in our Cookies Policy
4.1. What are cookies?
Cookies are small data files that help websites you visit to remember the actions and settings that individual users have made on the website, so that these details do not have to be re-entered. Cookies are stored on the user's individual device via the web browser. Cookies do not pose a danger, they do not serve to obtain any sensitive personal data, but they are important for privacy protection. We do not use cookies to identify website users or to misuse login credentials.
4.2. What types of cookies are used?
- Necessary cookies
Sportisimo.processes on its website the necessary cookies required to ensure the functionality of the website. For example, cookies that store the contents of your shopping cart. The customer does not have to agree to these cookies, but cannot refuse them either. The processing of necessary cookies is terminated each time the session is terminated / closed
- Analytical cookies
On the basis of the customer's consent, Sportisimo may use and process analytical cookies used to compile statistics and reports.
- Marketing cookies
If the customer has given Sportisimo consent, Sportisimo also processes cookies for marketing purposes. Sportisimo may offer Sportisimo or Sportisimo's partners' goods through targeted advertising or show customers the last items viewed on a previous visit to the website, subject to consent.
5. Who all will have access to customer data?
Customer data is safe at Sportisimo. Sportisimo ensures such technical and organizational data security that unauthorized or accidental access to the customer's data or other misuse of the data cannot occur. Protecting customer data is a priority for Sportisimo.
Under certain, precisely defined conditions, Sportisimo is obliged to transfer certain personal data of customers on the basis of applicable legislation, e.g. to the Police, or other law enforcement authorities, including specialized departments (Office for Personal Data Protection, Customs Administration, etc.) and other public authorities or insurance companies in the event of an insurance claim.
The customer's essential personal data may also be accessed by Sportisimo's relevant suppliers, including external suppliers and carriers, who might directly deliver goods to the customer. However, it is important to note that Sportisimo remains the controller of this data.
The personal data of customers is processed mainly by Sportisimo employees and also by authorized Sportisimo representatives. Sportisimo always has a contractual relationship with the authorised representatives guaranteeing the same standards of security of personal data processing as Sportisimo itself. 6. Using what method and for how long does Sportisimo process customer data?
The way Sportisimo processes customers' personal data includes manual and semi-automatic processing in Sportisimo's information systems. One of the methods of processing is also partial evaluation (profiling), which may generate derived personal data of the customer. The evaluation is carried out to comply with legal obligations, to fulfil a contract with a customer or to protect the rights of the customer or third parties.
Sportisimo processes the customer's personal data only for the period of time that is necessary for the purpose of processing or for which the customer has given consent to the processing of personal data. Sportisimo continuously assesses whether there is a continuing need to process personal data for each such purpose. If such purpose no longer exists, the personal data is destroyed and deleted. In general, the customer's personal data is processed for the duration of the contractual relationship and Sportisimo is only entitled to process such data if there is a reason for doing so under applicable law or the contract itself. In the case of the processing of personal data on the basis of consent granted by the customer, Sportisimo's right to process such data shall expire upon the expiry of the period for which the consent was granted or upon withdrawal of the consent to process personal data.
7. On what basis can Sportisimo process the customer's personal data?
Sportisimo may process the customer's personal data on the basis of the customer's consent, but also, for example, on the basis of Sportisimo's legitimate interest or for the fulfilment of the conditions specified in the purchase contract between the customer and Sportisimo, to the extent that the personal data is necessary for such fulfilment. Last but not least, the reason that allows Sportisimo to process the customer's personal data without the customer's consent is the fulfilment of Sportisimo's obligations under applicable legislation.
7.1. Processing of personal data without customer consent
Sportisimo may process the customer's personal data without the customer's consent for the reasons set out below:
- The processing is necessary for the conclusion and performance of a contract with the customer for the purpose of:
- conducting business with the customer and complying with contractual obligations so that the contract can be concluded and fulfilled, processing payments or complaints.
- Fulfilment of statutory and other legal obligations binding Sportisimo, which consist in particular of:
- compliance with obligations arising from accounting and tax regulations,
- the prevention of fraudulent behaviour to which customers or Sportisimo may be exposed,
- fulfilling their reporting obligations to public authorities,
- informing each other's lending entities of matters that are indicative of creditworthiness and credibility in terms of ability to meet contractual obligations,
- fulfilling the requirements arising from legislation governing measures against the legalisation of the proceeds of crime and the financing of terrorism,
- fulfilling the obligations arising from the Archives
- The processing is necessary for the purposes of the legitimate interests of Sportisimo and third parties, in particular for the processing of personal data in the case of:
- litigation or other disputes,
- debt recovery,
- execution of security or other exercise of rights of Sportisimo r.o.,
- assignment of claims,
- direct marketing to existing customers,

7.2. Processing of personal data with customer consent
This is a situation where the customer voluntarily gives consent to Sportisimo to process the data provided by him/her or otherwise obtained for a specific purpose specified in the text of the consent itself.
On the basis of the customer's consent, Sportisimo processes personal data for the following purposes:
- Sportisimo Club membership,
- sending newsletters at the customer's request,
- use of marketing and analytics cookies,
- posting reviews or questions about products, unless they are anonymous
- mutual information between lending entities about the creditworthiness, credibility or payment record of customers, unless Sportisimo has no basis for such information in the performance of its legal or other obligations
- In the case of a person under the age of 15, Sportisimo will not process the data of this customer unless they provide consent or approval of consent by the legal representative of this customer to the following address dpo@sportisimo.cz.
8. How is the customer's personal data secured?
All personal data provided by the customer is secured by standard procedures and technologies.
In this context, Sportisimo regularly checks that Sportisimo's systems are free of vulnerabilities and have not been exposed to attack. Sportisimo uses security measures that prevent unauthorised access and misuse of the customer's personal data and that provide sufficient security in view of the current state of technology. The security measures taken are regularly updated. In order to better secure the customer's personal data, access to this data is protected by authentication and authorization of an authorized Sportisimo user, and the customer's personal data is encrypted during transmission between the customer's browser and the Sportisimo website.
9. What rights does the customer have in relation to data protection?
In particular, you have the following rights in relation to your personal data:
- the right to withdraw their consent at any time;
- the right to correct or supplement personal data;
- the right to request restriction of processing;
- the right to object to or complain about processing in certain cases;
- the right to request data portability;
- the right of access to personal data;
- the right to be informed of a personal data breach in certain cases;
- the right to erasure of personal data (right to be forgotten)
- The right to lodge a complaint against the processing of personal data with the supervisory authority, which is the Office for Personal Data Protection, located at Pplk. Sochora 27, 170 00 Prague 7, uoou.cz.
10. How and when can a customer withdraw their consent to the processing of personal data and how can they exercise their rights?
- As stated above, in addition to the purposes given for the processing of personal data for the performance of contractual, statutory or other legal obligations, Sportisimo may only process personal data with the consent of the customer. The customer is not obliged to grant such consent to Sportisimo and is entitled to withdraw such consent at any time by sending a request to Sportisimo's GDPR Officer or by e-mail to dpo@sportisimo.cz. The request will be registered and the customer will receive a statement within the time limit set by law.
If the customer withdraws the consent granted, this may restrict the customer's access, availability or information to certain Sportisimo services or products; however, if the customer has a contractual relationship with Sportisimo, the withdrawal of the consent granted shall in no way affect the performance of contractual obligations by Sportisimo or other legal obligations or for other reasons specified in applicable law.
The withdrawal of consent shall also not affect the lawfulness of the processing of personal data carried out by the controller before the withdrawal of consent.
- If a customer sends a request concerning the customer's rights under Articles 15 to 22 of the GDPR, information on the measures taken must be provided without undue delay and at the latest within one month of receipt of the request. In exceptional cases, due to the technical and administrative complexity and complexity of processing the customer's personal data in Sportisimo's systems, the deadline may be extended by two months, of which the data subject must be informed by Sportisimo, including the reasons for the extension, within one month of the request.
11. Is the customer obliged to provide their personal data? What if they do not provide personal data?
Personal data is provided by the customer completely voluntarily.
However, for some Sportisimo services, the transfer of certain personal data is required to access the service, for example, without providing the necessary identification and contact details, it is not possible to conclude a purchase contract.
If the customer does not grant Sportisimo consent or subsequently withdraws it, it may happen that Sportisimo will no longer be able to provide certain services or that it will not be able to provide them in full scope or quality.
12. What does it mean that the customer has the right to object?
Should the customer object to Sportisimo processing their personal data in the service portfolio, the customer has the possibility to object to further processing of their personal data for a specific purpose. If they do so, Sportisimo will not process the customer's personal data for the specific purpose, unless Sportisimo provides another legal reason otherwise.
The customer may also exercise the right to object in relation to newsletters that Sportisimo sends to its customers on the basis of Sportisimo's legitimate interest - direct marketing and on the basis of the customer's consent. If the customer does not want to receive newsletters, they can unsubscribe by clicking in each newsletter or by sending an e-mail to dpo@sportisimo.cz
13. How can you contact Sportisimo?

14. Final warning
In this context, Sportisimo would like to point out to its customers that Sportisimo may require appropriate proof of identity with the exercise of the customer's rights, so that the identity of the customer can be verified in order to exercise the person's rights.
